PCI 2.1 & 2.2 Compliance

Is PCI compliance a software or hardware issue? BIOS detects a PCI compliance of 2.1 and some PCI cards require PCI 2.2 compliance. Can BIOS be upgraded to allow 2.2 compliance or is this a hardware issue that would require MoBo replacement?

According to the PCI 2.2 errata there are many hardware differences including added pins for Spread Spectrum Clocking to reduce EMI.
